Drag Race Winner Tyra arrested

James Ross, formerly known as RuPaul's Drag Race season 2 winner Tyra Sanchez, has been arrested again in Florida and is currently being held in the Bradford County Jail, EW has confirmed.

Ross was arrested Thursday after publicly protesting his initial May 17 arrest for allegedly resisting arrest after a car accident in Starke, Fla., an incident from which EW exclusively obtained body camera footage in June.

"We've arrested James William Ross. He came out and was in his little outfit, and he had the police sign, hanging it up and showing and dancing," chief of police Jeff Johnson tells EW. "He was in a little G-string with a black bra on. It still was within the 'freedom of speech' category. The problem we had was it was in an intersection within a construction zone, but it wasn't really causing a traffic problem."

Johnson explains that it became an issue when Ross "went home" and returned after strapping "on a big old d***o" under his tights.

"He comes back out on the road and starts shaking it, and that's when people started stopping and cussing at him, and causing a traffic problem. It was bad from there on," says Johnson, adding that Ross will be booked on one charge for breach of peace.

Ross is currently being detained in a holding cell in jail but is expected to be booked imminently, says a records clerk for the Bradford County Sheriff's office who wishes to remain anonymous.

As a native of the area I'm not sure why anyone would be in Starke lmao. But here's some more info:

"Under Florida law, disorderly conduct or breach of peace is classified as a second degree misdemeanor, carrying penalties of up to 60 days in jail or 6 months of probation, and a $500.00 fine.

These penalties represent the statutory maximum that is available for the charge, and do not reflect the likely sentence that will be imposed in the vast majority of cases.  For first time offenders, jail time (usually less than 60 days) is a realistic possibility where the accused’s conduct involved highly disrespectful or disruptive actions towards police, or posed a legitimate endangerment to public safety.  This is especially true where alcohol or drugs are involved.

For most first-time offenders, however, the main risk of a disorderly conduct prosecution is the creation of a permanent criminal record, and a probation sentence, which commonly includes community service.  For repeat offenders, or for persons with extensive criminal histories, jail is not only a possibility, but, with the wrong prosecutor, can be a probability."

Breach of peace laws also are kinda murky in regards to how much they are annulled by america's first amendment to the constitution; breach of peace laws have been challenged and shot down by the federal courts before, like in Terminiello v. City of Chicago (1949) and Cox v. Louisiana (1965). If Tyra's a Winner™ he'll get the supreme court to look at it again, though the supreme court being what it is, and Florida being what it is, it'll just continue the slippery christofascist slope this country's already in.
