NY's top court seemes open to ruling that Dr. Luke is a "public figure"

New York's top court seemed open on Tuesday to ruling that music producer Dr. Luke is famous enough to qualify as a "public figure," a finding that would make it harder for him to win an upcoming defamation trial over Kesha's allegations of sexual assault.

The New York Court of Appeals heard afternoon oral arguments in the lawsuit brought by Lukasz "Dr. Luke" Gottwald, scheduled to go to trial in July. 
Dr. Luke originally brought the defamation claims in 2014, the same day Kesha filed a sexual abuse suit in Los Angeles. The California case was stayed and later dropped. Kesha made similar allegations in counterclaims to the New York suit, but the court later dismissed Kesha’s sexual abuse-related claims because of time limits and other legal issues, without ruling on whether the allegations had merit.

A Manhattan jury will decide whether Kesha defamed her longtime songwriter and producer by telling the world that he drugged and r_ped her.

Lower courts have ruled that Dr. Luke is not a public figure subject to the heightened standard of proving that Kesha acted with so-called actual malice in discussing the alleged abuse.

But multiple members of the high court panel appeared on Tuesday to disagree, with Judge Jenny Rivera pointing out that Dr. Luke "solicited tremendous public interest in himself through interviews with the press" over the years. Acting Chief Judge Anthony Cannataro added that much of Dr. Luke's boasting was "about his successful collaboration with Kesha, specifically."

An attorney for Dr. Luke said he wasn’t a public figure, nor was he a household name outside of the music industry. “The defamation didn’t occur in the industry,” Steinberg said. "Appellant defamed my client throughout the world. She defamed him by going on social media with her millions of followers."

Attorney Anton Metlitsky, who represents Kesha, noted that the producer's own attorney filed an affidavit stating he was a celebrity and had hired four public relations firms to “make him famous” as a producer for young, female artists.
“He was chosen to get a star on the Hollywood Walk of Fame. That’s for famous people,” Metlitsky said. “He was a finalist as a judge in 'American Idol.' Those producers don’t pick people who aren’t going to draw an audience. He was the subject of articles in the New Yorker, Billboard magazine.”

This just makes Kesha's side look better because Luke has actually achieved more hits than her since the accusations and his career is in the best place since 2013. So any claims that Kesha maliciously tried to end his career holds no weight. She's also been so quiet on its lately and Luke's been thriving in that time. Didn't know he was considered for American Idol, was it for the previous series or the revamped one?

it makes me so mad that he has gotten more hits than her since the allegations, her label is definitely sabotaging. Her most recents hits like Praying, Woman and TikTok fueled resurgences of Cannibal and Backstabber are all fan and organically driven, her label isn't supporting her, while propping him up and trying to let him have a comeback.
