Likelihood of 25th Amendment?

25th unlikely. However, he can possibly be impeached and disbarred from ever holding office even after he becomes former president.

With only 2 weeks left i doubt it but it would alleviate SOME tension 

However impeachment would make it impossible for him to run again

I would be shocked if then 25th happened, it would be political suicide. Trump supporters answer to Trump above all and Dems and Independents wouldn't give him the time of day. I could see impeachment happening even if it just ends up being symbolic, but wouldn't that take like a month? Could they do an impeachment before Biden's term starts?

The president could be impeached by a simple majority vote of the House of Representatives so since the Democrats have a (slim) majority they could vote to impeach him tomorrow 

But then there must be a trial in the Senate and it would require a 2/3 vote of the Senate to convict and remove the president. Only then would Trump be removed from office and banned from future public office. 

So even if the new senators were sworn in the Democrats would only have 50 votes. They would need 17 Republicans to also vote to convict. And the president would have the right to a trial which means hiring lawyers, preparing a defense, finding witnesses.  So there’s no way this process could play out in a few days.  Trump only has 12 more days in office.

The 25th amendment has never been used to remove a president. From how I read it, the VP and majority of Cabinet could notify Congress that Trump cannot discharge his duties and Pence could become Acting President. 
 

However the president can submit his own declaration that he is able to discharge his duties and he would remain as president. 
 

If this happened it would be up to Congress to reach a conclusion about whether or not the president should remain in office. So you can imagine this all takes time and it’s not likely this could be rushed through in a day or two. 
 

I think this amendment was designed to deal with a situation where the president had suffered some physical or mental collapse and wouldn’t really be able to respond to the VP + Cabinet notification. If the president resists it then you have to have time for Congress to make a final determination.

I’m amazed that there are talks in invoking the 25th Amendment and even impeachment again, less than 2 weeks from Inauguration Day...... He already conceded too, I mean how necessary would these be?

It is more about ensuring he can never be president again, cos impeached president can never run anymore.

Government and military officials are sworn to uphold the Constitution, not to be loyal to a president. So if a president ordered the arrest of Congressional leaders or tried to order a military attack, those who would have to carry out those orders would (I hope) refuse to carry them out. 
 

Yes the president still has the nuclear codes but he just can’t push a button and launch missiles. There are officials who would have to carry out those orders. 
 

Also Trump is now saying he will work for a peaceful transition of power so as long as he behaves himself for the next 12 days I would think he will just leave power when his term expires at noon on Jan 20.

Remember impeachment alone is just an accusation. The president would have to be convicted after a trial by 2/3 vote of the Senate. Only then would he be removed and barred from holding federal office again. 
 

We’ve had 3 presidents impeached but none were convicted.

I feel the opposite, I feel like if the 25th is invoked or he’s impeached it would create even more tension.

“It’ll piss off the base” was the excuse used last time to justify not charging W Bush for his war crimes, but it’s only lead to the further distrust in government that’s lead people so susceptible to Q Anon ****. There is no winning. Just rip the bandaid off fast before the wound festers.

No, I wasn’t defending or siding with him (in case that’s what you’re implying). :awkney: It just seems like these actions should’ve already happened a LONG time ago, Biden’s about to be inaugurated in less than 2 weeks. I just thought it was too late for another impeachment, but I suppose it’s not. But don’t these actions usually take a long time anyway?? 
 

Also, as someone else said, I don’t believe the tension would die down completely. His supporters will probably take their protests somewhere else other than Capitol Hill.
