They need every cabinet member to sign it & mike pence, then it's sent to congress. If they actually get it to congress, it's almost guaranteed to pass because Pence would be the defacto head of the party if they toss Trump, so his party would be here for it.

VP Pence needs to get a majority of cabinet members behind him and submit a letter to Congress, that’s it, Pence becomes acting President. At that point Pelosi can stall for the next two weeks until Biden is sworn in.

But Trump could insist he is still fit for office and he would remain president. Then Congress would have to make the final decision and I doubt they would move quickly enough to make any difference.

He can but nobody would pay him any attention, and by the time they have to put it to vote, Biden will be sworn in already

Congress has to vote to RETURN Trump’s powers to him, and they only have to do so within 21 days of Trump objecting. Basically, Pelosi would just refuse to bring it to the House floor before the 21st.

The big concern would be that the president may keep inciting riots or he could do something desperate in the next 13 days. Now the military would ignore any nutty orders Trump might give. But there are other things he might do to cause chaos.

When you read the 25th amendment it says the president can declare he can discharge his duties and then he stays in office. Congress then has to resolve the dispute and needs 2/3 vote of both houses.

He'll be banned everywhere in no time if he does that, and federal prosecutors would be at his doorstep.

He can only do that after the new Acting President is named. He has to do it by presenting a letter or something and Congress has around 21 days to vote. Biden will become president by then.

True he could face possible incitement charges after leaving office. I wonder if there is anyone who can talk sense to him and tell him to shut down the rhetoric and try to leave with a shred of dignity.
