Once people have lawfully cast their ballot in good faith, judges, even hard core conservative originalist textualist judges, are really really loathe to invalidate the ballot. Remember when they tried to invalidate the drive through ballots in Texas. The judge, a hard core conservative, took one look and said “No, their votes get counted”. You can not retroactively invalidate a ballot made in good faith and as per directions given by the election office. You can not retroactively say that late ballots will not be counted after telling voters their ballot can arrive up to three days late. And, you can not tell an elections office to invalidate ballots because the ballots were being counted too slowly, especially since it was a Republican-made law which resulted in this slow ballot counting process. Yes, I know our judges are becoming more right wing, but this is a bridge too far, even for them. Remember: Conservative Texas judges wouldn’t give this kind of nonsense the time of day.
