Speedy trial does not = immediate trial, the purpose of its inclusion in the Constitution was to protect the accused from the possibility of the government delaying a trial as a means of keeping the accused imprisoned, and is effective to the same end in a contemporary sense; yes, the accused can post bail in many cases but still don't enjoy the same standard of living as they would without being charged meaning that there would be negative impact should the Feds decide to arrest someone in 2020 and not prosecute them until 2040. The right to gather testimony is indeed enjoyed by both sides, but the overall primary purpose of trial rights is to protect the accused citizen from the accuser state. My post was in direct response to the idea that certain accused men and women don't deserve/shouldn't be entitled to rights. My earlier post was more objective description of the criminal justice process post-arrest than it was an analysis of who should or shouldn't have trial rights.
