Harvard, MIT, Sue Immigration Authorities Over New Student Deportation Law

Harvard and the Massachusetts Institute of Technology filed a lawsuit in District Court in Boston Wednesday morning against the Department of Homeland Security and U.S. Immigration and Customs Enforcement, according to University President Lawrence S. Bacow.

The lawsuit seeks a temporary restraining order and preliminary and permanent injunctive relief to bar the U.S. Department of Homeland Security and Immigration and Customs Enforcement from enforcing federal guidelines barring international students attending colleges and universities offering only online courses from staying in the United States.

The guidelines would mandate that they transfer to an institution offering in-person instruction or risk “immigration consequences including, but not limited to, the initiation of removal proceedings.”

DHS and ICE did not immediately respond to requests for comment.

I think the Trump administration's intentions is actually the opposite. I think they're forcing universities to open up by using international students as pawns.

The new policies actually would increase transmitting COVID among students (at least in the hybrid systems) because internationals who have at least 1 in-person class are required to come to the US or risk their student status.

Overall these policies are just unproductive.

They're not casual tourists/vistors, they're deportees. Not sure how It works considering but they'll loophole to get them out I'm sure. I've heard ICE has not stopped, and prob upped, deportations while everyone's been distracted these past months. These people are true bastards.

Harvard. And MIT sue Trump admin over policy targeting international students. 

The attorney generals for Massachusetts, Connecticut, Rhode Island and Vermont have joined their counterparts in 14 other states in filing a lawsuit seeking an injunction over the Trump administration's new visa rule for international students.

Colorado, Delaware, the District of Columbia, Illinois, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, Oregon, Pennsylvania, Virginia and Wisconsin are also part of the suit, which challenges a recently announced directive saying international students cannot stay in the U.S. if they take all their classes online this fall.

According to another source, the White House is now focused on having the rule apply only to new students, rather than students already in the US. The White House declined to comment on an ongoing policy process.

For now, though, the move to drop the policy is a reprieve for more than 1 million international students in the US. In the last week, students had expressed frustration and concern over their next steps, as universities and colleges announced decisions to move all courses online.
