If it leaks now it will have to be from an independent shop making a mistake selling it, but most of those stores are probably seeing way less traffic right now which reduces chances of a leak. It was released in the USA and some European countries between August 19 2008 - October 27 2008. It was then released in the USA and other countries after 28 October 2008.
