This whole case is such a mess. Both sides are def hiding something. I am inclined to believe Kesha because admittedly, I am a bit biased towards her and also knowing how common sexual abuse is in the music industry. Plus the fact that so many of Luke's former clients have spoken out in her favor doesn't make him look good. However there is still a lot that doesn't add up with her story. Like how she says when she woke up the next morning she immediately ran out of the hotel room and called her mom crying, but receipts from the hotel say that she ordered movies and room service instead? Even Kesha herself has admitted to doesn't even know for sure what happened to her on the night she says she was raped. I don't think it's absurd to imagine that someone could potentially curate a story to get out of a contract with someone who is emotionally abusive. We have documented evidence of him harassing her about her appearance and her singing abilities, so it isn't a question of whether or not Luke is a bad person; he is. It's whether or not he is a rapist, which still remains to be seen and likely we will never know for sure. Truthfully, we don't have enough proof to call Kesha a liar or to call Luke a rapist.

I love how everyone on here is so bias. Literally if its about a pop girl in a trial no one on this forum believes in “Innocent until proven guilty” it’s immediately deemed “Innocent pop girl goes to court with guilty person”

None of us have any idea what happened and there was no proven evidence that he did anything wrong. Why are we the ones to make that case. Kesha is guilty of defamation tho. That guys name has been smeared. I pray that she didn’t lie that she was raped and etc but we cannot just immediately believe every accusation

There is a strong difference between being an as*s h*ole and being a rapist. All the artists said he had a bad attitude, they never said he did actually rapped or try to rapped them. Being a dush isn't punish by the law and he doesn't deserve to be punish for something he didn't do, this is unjustice and unfair even if he is a dush. 

You should really re-read yourself, being a bad person doesn't make you a murder or a rapist.

Some of you didn't read the linked documents and it shows

The defamation is two-fold. One for the rape accusations ad the Free Kesha movement (Gods they wouldn't shut up about that) and two for the texts with Gaga. If evidence is given that either or both of these are false, then Luke is owed the $370k. Keep in mind, "evidence" is a loose word here. 

Now, the first instance was proven as defamation because of Kesha saying under oath back in 2011 that he didn't drug her and never had sexual relations with her. At the height of her career, while she was working on Cannibal, after already trying to get out of or alter her original contract with Dr. Luke and failed to. If she came out later and said she lied under oath, it wouldn't matter and could still be taken as evidence. 

The second instance with the texts does not care that the texts were made public. It only cares that she told Gaga that Luke raped Katy. That she told one (1) person in writing and didn't use the word "allegedly". And this is proven false because Katy testified that Luke never raped her. According to a case in 1984, only one person needs to be told a lie in order for it to be considered defamation.

Additionally, the documents state that Luke had no platform to counter these statements because he is "certainly not a 'general public figure.'"

That's why I said relatively  new. I mean, Gaga didn't talk about her rape experience until much later in her career. Just because Kesha said she wasn't rape or drugged doesn't mean that she wasn't. A lot of it comes from psychological, mental, and emotional manipulation or grooming.

Her being a pop girl has nothing to do with it. Don't try to spin this into a "you guys are stans, so of course you're going to defend her" kind of argument.

As for whether or not Kesha is lying, I doubt she is. Will we ever know exactly  what happened? No. None of us ever will. However, I don't believe she's lying for a minute. 2-8% of reported sexual assault cases are false.

It was a bit of a random example, but my point is that you shouldn't automatically believe every woman's accusation.

I'm sorry, I misworded it when I accused you directly of not understanding the issue. What I meant to say was that the way you worded your post sounded eerily similar to the kind of people who don't understand the issue and see false accusations as a bigger threat than sexual assault itself.

So it sounded biased to me and that is how I criticized it and I apologize for misreading you.

My point that the system can't be trusted still stands.

In this particular case, Dr. L*ke won a defamation suit simply for the fact that Kesha discussed something she heard, with Gaga in private texts that were never meant to be published when they happened but ended up being unsealed in court, which from what I read Dr. L*ke encouraged. Gaga never passed on this information so it would never have left that chat had it not been unsealed. If that is not a textbook example of gaslighting, I don't know what is.

And regarding the evidence, I have seen plenty viable evidence from her side but none from his so unless someone would be so kind as to give me more examples, I have no reason to believe she is lying. But that's just my perspective.

And my aim isn't to punish the abuser, it's to help the victim. My first instinct isn't to guide a victim to a lawyer, it's to guide them to a doctor and a therapist. 

But I also recognize that part of that therapy is seeing their abuser being brought to justice. Knowing the abuser can't or won't abuse them or any other potential victim. 

I am not a judge, nor am I part of the jury. I don't have all the information, but I know that Kesha is a sweet woman, and I know that Dr. Luke is a jack*ss. It is my prerogative to express my support towards her, just as it is for everyone else. It is also my prerogative to call Dr. Luke a jack*ss whenever I get the chance.

Automatically supporting or being against someone without much evidence is akin to witch trial behavior. There is a reason why we have moved past this.
