A Holyoke dad pleaded not guilty in court Friday morning after police say his five year old son brought drugs to school.

Police said the child ingested cocaine, but was brought to a hospital and is expected to be okay.

Now, we're learning this isn't the first time the father has faced drug charges.

Prosecutors said the kindergartner at H.B. Lawrence School was showing his friends a packet with the word 'Spiderman' stamped on it. When school officials looked closer and spoke with the child, they realized they needed to act fast.

Benny Garcia, 29, scowled in Holyoke District Court Friday morning and pleaded not guilty to drug possession and reckless child endangerment charges.

Prosecutors read aloud how drugs police said they found on Garcia's kindergarten son sent teachers at H.B. Lawrence School into a panic on Thursday.

"There was a plastic baggie with gold-colored sides stamped with 'Spiderman' and a powdery substance inside," said Hampden County Asssistant District Attorney Matthew Green in court.

Miss Molina spoke with the five-year-old kindergarten student. The student said that when he eats or tastes the powder, he turns into Superman.

When the unnamed kindergartner allegedly told teachers where he got the drugs, Green said, "The child stated that he retrieved the item from the living room of his residence."

After bringing the boy to a hospital, prosecutors said law enforcement went to the child's home on Essex Street where they said Garcia was sleeping.

They located 38 individual clear plastic baggies, have a white powdery substance believed to be cocaine. They also located two more bags of the heroin," Green explained.

However, according to court documents Western Mass News obtained, police said Garcia's disposition was different when they told him about what happened to his son Thursday, claiming he became emotional.

Western Mass News also found that Garcia was already out on bail for a 2018 drug case when the situation with his son unfolded, a fact that was also brought up in court.

The judge elected to hold Garcia without bail for a dangerousness hearing next week.

"He’s held without right without prejudice," the judge noted.

But yeah... theres a certain humour to that part and fortunately it seems like the kid is ok

On a serious note: wow what a shítty father. It’s one thing to struggle with drug dependency/addiction on your own, it’s another to let it put your child at risk. The kid could’ve died. 
 

 

on a not-so-serious note, I laughed out loud at the Superman thing. I know I shouldn’t have, and that it’s morally bad, but damn that was funny. I’m so sorry :saladga:

And at least he didn’t share it with his classmates (although “sharing is caring” ain’t it?). Imagine a room full of coked out 7-year-olds running around, screaming, destroying the entire room? The whole school would probably be sued for negligence

When I read the titled I was expecting this thread to be funny but it's actually horrible. What drives you to make a child addicted to drugs by telling them they will turn into superman. I hope the father is locked up for the child's sake because the last thing I wanna hear is how he abused his child after "telling" on him.
