It's not a money thing people.

The point is they use an original idea by The Sweet Feminist and copied it directly. The way The Sweet Feminist is set up, you can tell it's not just someone who happened to bake a cake and put a saying on it one time, it is their thing, their artform, their signature.  

 If Miley and Marc were inspired by the cake and want to use it for a promotional picture, I feel they should find who made  it and ask her to make one for the shoot, or inform them of their plan. I wish artists were more respectful to other artists. Like Mileys music, this cake is a form of expression, so I hope she is reminded of this in future endavours.

Oh Marc :saladga: it seems his constant controversies and relationships get more attention than his actual work these days. Shame really considering he was so on top of his game 10 years ago.

I don’t see the issue. There was probably a team of people pulling together ideas for this shoot and this image was pulled from either instagram directly (w/o credited account) or unsourced. Just like every other person in this industry they don’t come up with concepts 100% on their own. It’s a simple mistake that anyone could make. She got called out about it and she responded accordingly. They’re now being credited. However, the fact that being credited is not enough and they think that they're owed some kind of compensation is ridiculous. Anyone could buy that same cake from Walmart and do that. That’s like Cardi wanting to trademark “Okurr.” It’s far fetched and attention driven. At the end of the day the message is being spread and your art is being shared to the masses by Miley Cyrus, sit down and be grateful for the exposure. Anyways, that cake is making me hungry girl.

That isn’t art. She can’t copyright something that isn’t even original.

Unless she’s copyrighting that specific camera shot, she doesn’t have anything to claim copyright on.

While I think it's wrong that they just found that image online and blatantly copied it without looking for the source to credit, I'm confused as to what compensation the woman thinks she is entitled to? Miley nor Marc are making any money off of the sales and they're donating it to Planned Parenthood and Miley corrected her mistake and told the girl she was going to credit her in the post. So... she wants to take money she thinks she's entitled too based off of a cake that was copied and is going to go to a good cause???

She's not selling merch with that cake, she's selling it with other pics and for a good cause

She posted a photo with a cake she didn't know that had an owner, now the owner is credited on her post, that's it.

Miley is not making any money out of her cake so I don't get all the drama

If I sell all of Gaga's music under my name and give ALL the proceedings to a cancer research foundation does that sound morally right?

I mean it's literally just music right? It's not like I'm taking anything away from Gaga?

Lol what copyright was filed? Is there a patent over handwriting and color combinations that this person supposedly has? 

Giving credit is one thing but to say this is “copyrighted” with the U.S. Copyright Office is a reach.

'Lol', I didn't mention the U.S. Copyright  Office for one thing. But also, you don't need to register your work to become a copyright holder, it's voluntary, but the copyright exists by default the moment work is created.

You can't patent a colour but if someone directly copies your work like that I'm pretty sure they'd have grounds to claim. Not that I was suggesting they'd need to or it was THAT serious, my point was that it's not 'just a cake', and people have rights.

Miley crediting her came after my post, it probably doesn't even matter anymore. I don't know if the artist even cares?
