Court rules male-only draft as unconstitutional

A federal judge in Texas has declared that the all-male military draft is unconstitutional, ruling that "the time has passed" for a debate on whether women belong in the military.

The decision deals the biggest legal blow to the Selective Service System since the Supreme Court upheld the draft in 1981. In Rostker v. Goldberg, the court ruled that the male-only draft was "fully justified" because women were ineligible for combat roles.

But U.S. District Judge Gray Miller ruled late Friday that while historical restrictions on women serving in combat "may have justified past discrimination," men and women are now equally able to fight. In 2015, the Pentagon lifted all restrictions for women in military service. 

The case was brought by the National Coalition For Men, a men's rights group, and two men who argued the all-male draft was unfair.

Men who fail to register with the Selective Service System at their 18th birthday can be denied public benefits such as federal employment and student loans. Women cannot register for Selective Service.

The ruling comes as an 11-member commission is studying the future of the draft, including whether women should be included or whether there should continue to be draft registration at all.

How do you feel about this?  Should women also register to be drafted when they turn 18? Are there any other countries doing this?

Selective Service was started for men only so that all the men would go off to war and women would stay behind to take care of the children etc.

I mean, SS is there as a last resort if there is some huge war where our VOLUNTARY military isn’t enough. 

Should women be FORCED like men are to register? I mean idk. Should it be an option? Yes. Not sure many would though.

#1 no one should be forced to register

 

#2 this is outdated

 

I get that in the past physical force was more important, women took care of kids etc

 

But with modern equipment for most tasks it doesn't matter how strong you are or if your a man or woman (and in the odd position where it might matter they can still be selective of which individuals are most capable anyway)

 

There's also men who stay with kids now a days instead of the woman it's not that unusual

 

I guess I can understand why they reasoned the way they did back then with how society functioned but this hasn't made sense in decades

They are forced to register. I guess it means in the event of a war or whatever they have a large pool of men they can pick from

 

But unless u get drafted (which now a days only happens in extreme war times) u don't have to actually go serve in the military ur name is just there 

 

At least that's my understanding of it. In Portugal up until some time ago they also have the same registration requirements even tho most ppl didn't actually go to serve

 

They removed that requirement some years ago tho

The draft is in my opinion an archaic policy and oppresses all who are subjected to it. Hopefully this leads to getting rid of the draft. That’s what we need to do, not make women register. That’d be like when women were fighting for the vote and instead of giving it to them, we took it away from men. 

Forcing women to register for he draft is making everyone equally unfree. It’s the opposite of progress.

The chances of a draft seem really really small tbh.

 

Sure it may seem like “equality” and that “times have changed” but until we have complete equality for women, this draft issue should be at the bottom of the list.

 

What this federal judge should focus their energy on is allowing transgender people the right to serve voluntarily.

Um no this should not be at the bottom of the list, this needs to get done sooner than later in case we get in a world war. Men should not be the only ones forced to fight for this country. I'm sure in the time of need there will be plenty of women who don't have many responsibilities who can serve their country like most men will be expected to (even if they have families of their own).  Women have had the privilege of avoiding being drafted for a really long time while lots of men go to war and die without seeing their kids grow up.  Either way, I bet the numbers of women drafted would be really low because I'm sure most of them will get pregnant to avoid being deployed men would still be making up the majority in the military.

If men are forced to register then women should be too. Ideally, nobody should be forced, but if we are going to be forcing people we should be forcing everyone.

That's one high horse you've got there. Let's not forget there was an extreme amount of avarice bias in the men drafted, and plenty not even fitting that category did self serving things to dodge the draft. Your high and mighty speculation about women tells me you should really look at what they did to carry this country through our past drafts and support not only their families but those in combat and  learn about the many other rights that were stripped from them until, historically, very, very recently. Those poor men though, it's a scary time to be a man. :laughga:
