Yes, the legal standard would be that you have to be able to prove that they knew about it beforehand. For example if you don't disclose that you have HIV but know that you do and someone gets it and then dies of AIDS, you could be charged with manslaughter. Most people don't die from HIV anymore but just as an example. If the person doesn't die there might not be criminal charges but you can still be sued in civil court for negligence and infliction of distress/etc.

You're kind of correct but these issues are usually litigated in civil court. Criminal charges would only be brought if the person died because of the disease (manslaughter) or was badly injured (assault I believe). But in Usher's case, this is a civil, not criminal, matter.
