All Federal Judges are appointed by Presidents and approved by the Senate, as is stated in the Constitution.

The federal judge who blocked President Trump’s original immigration order is described by former colleagues and acquaintances as a “mainstream” Republican who went from a career as a highly respected corporate lawyer in Seattle to an appointment by President George W. Bush to the federal bench.

The travel ban is still a stupid idea. It'll only feed groups like ISIS by giving them even more fuel to stoke their anti-American propaganda and turn displaced refugees and others into alienated, hateful radicals :smh: Anyone with a lick of common sense knows it's a bad idea.

Also, I still find it hilarious that Iraq was taken off the ban list when our major enemy in this situation (aside from ourselves) is the Islamic State of Iraq and the Levant/Syria :toofunny:

It isn't illegal at all. They aren't Americans so they don't have American constitutional rights so we can ban anyone for any reason from being here. Obviously we have our own criminals and rapists...why invite everyone else's rapists and criminals? We already are stuck with our own. The 3rd world is dumping it's problems on us and it's not going to fly anymore.

It is unconstitutional, which makes it illegal. 

It is unconstitutional for the U.S. government to discriminate based on caste, circumstances of birth or religious belief. And the court’s drive to avoid such intentional animus is so strong that it is willing to strike down laws that might otherwise seem to have good purposes. 

By the way, we are inviting refugees and people who have worked with our military for years...who have been vetted for two years. We are not inviting criminals and rapists. Your insinuation is pretty disgusting.

Thousands of Americans are murdered by illegals and migrants/refugees every year. Ohio State was just a recent example of an attack that would have never happened if we weren't forced to take them in by the courts of states like Hawaii that do not take any immigrants at all. Those people that died in the Boston Marathon attack didn't have to die. The liberal policy to invite people from backwards peasant cultures to the USA sacrificed their lives - against their will and without their consent. Same with all the other people that are raped and killed individually in attacks the media doesn't care about. 

The attacks didn't have to happen because the people who committed them didn't have to be here. The people who died were sacrificed. Nobody thinks all immigrants are dangerous. That's a strawman. 

It's like saying, hey, we're knowingly putting rotten food in the refrigerator mixed in with the good. You can't tell what's poison from what's not, though. Now go pick from it. But you can't choose not to pick something. You have to risk it. No choice.

I think the better choice would be to say no thanks, I don't want to accidentally eat the poison, rotten food.

And no, it's totally legal and completely constitutional to ban any class of aliens from the USA. The constitution does not apply to the globe. It applies to the USA.

I'm not even going to address your Trumpian thinking here. It's become apparent that it is useless to try and reason with xenophobic logic. 

To your last paragraph, I've already stated the constitutional reasoning that the court has deemed to be applicable. Federal judges have decided that this particular ban rests on discrimination based on religious beliefs, which is unconstitutional. 

And by the way, Hawaii does have immigrants.
