They have the ability to do this but reserve it for suspects of huge, damaging crimes as apposed to general "minor" crimes or law-abiding citizens. Also, the laws are extremely murky when it comes to using any of these things as evidence in a case against someone as it is often illegal to gain evidence by doing this.
