(NEWSER) – A former Indiana University student charged with raping two women will get off with a year of probation and one day in jail, WXIN reports.

John Enochs took a plea deal and was sentenced Thursday, pleading guilty to misdemeanor battery. According to the New York Daily News, it's unclear why prosecutors decided to drop the rape charges — felonies punishable by up to 16 years in prison — against Enochs. But that didn't stop the sentence from immediately being compared to the infamously lenient one issued against Stanford swimmer Brock Turner earlier this month.

A woman says she was at an April 2015 party at the Delta Tau Delta fraternity when she went inside to use the restroom, WISH reports. She says the next thing she remembers is being naked and alone with an unknown man having sex with her. She says she told him to stop multiple times, but he wouldn't. She suffered a laceration to her genitals in the attack.

Authorities say security video showed Enochs enter the room with the victim and leave 24 minutes later. Police found a similar case from 2013, and that victim agreed to work with authorities; DNA evidence, eyewitness statements and IDs from the women led in September to the two rape charges against Enochs.

Ready for everyone to read over the fact that the prosecutors dropped the rape charges. Anyway, I think this is good. I'll take probation over jail for most criminals anyway. Both are ineffective flop responses but I seriously don't believe in the idea that taking someone away from his natural habitat for years and then pushing him back in is going to have a significant impact for the better.

Most people will read over that fact, but if the prosecutors didn't drop the charges he likely wouldn't have gotten in a lot of trouble. In the case of Turner, he did get convicted of rape yet only a 6 month sentence. Proves that people are lucky to be a rich, white male.

Well, I don't know, I believe that there's more of an issue with how poorly legal procedures are codified.

Well the penal system is supposed to be about rehabilitating a criminal/offender so they can be a productive member of society once they get out. It's why you can pursue certain degrees or general education and work while you're serving time. Though far too often it's just considered and used as a concrete box we put people in when we deem them "bad people" for doing bad things.

I wonder why they decided to drop the charges? Video evidence, physical injuries, it was an open and shut case? Rapists...I'll never understand how someone can use another human being as a f*ck toy and I'll especially never understand how they get away with it.

Not trying to contradict the whole rehabilitation bit, if anyone's sick and needs help, it's people who do stuff like this. It just makes me mad is all.

Understood but I think that's just necessarily inefficient when you're removed from a naturally functioning and familiar social environment. That environment is what motivated you to commit a crime, why should you be strong enough to resist the same stresses when you're back in it without having been taught to resist them on location so to speak?

I get that there's no money for a very individualized treatment, so then the only way out is to invest massively in prevention, and that's never gonna happen 'cause then we need to touch our cherished cultural values :chica: So I don't really have any hope regarding the matter tbh. But eh.

it's also supposed to separate dangerous people from wider society and act as a crime deterrent, especially with something as serious as rape

I think I'll stand with my partial delusions of a better humanity before totally giving up hope :diane: the inner idealism with the outer realism and practicality can't hurt, ya know?

The means are out there, it's just a matter of putting the effort towards it. That's where the hurtles are. Incarceration has become a business in the States. We have more prisons than schools and our prisoners make up about a quarter of the world's inmate population. Then you have the asshats that care more about the money they're making off of this stuff than they do about society's safety and inmates' rehabilitation....You kind of already said all that though...in fewer words too :flop:

It's called justice. There is supposed to be a punishment for the violator.

That too, you're right.

My uncle and his ex wife used to be prison guards (both were cops before but took an easier job after a few injuries). They told so many stories about people they met in there who were down on their luck, looking for a second chance, or extremely remorseful for anything that they had done...people that end up in prison, even murderers and other violent offenders, they're not just caged animals. They're humans with histories of their own. A lot of them committed their crimes because of the environments they were stuck in, addiction, mental illness, anger issues, and a whole host of other treatable, preventable, or fixable problems. I don't believe there are bad people, just people who do bad things for one reason or another. People who've lost their ways and need help, not just punishment. Feel free to disagree though, I'm just rambling at this point anyway. As usual :spin:

Rape is something that's really complicated 'cause no two cases are alike. I'd love to see some kind of program go towards evaluating what made an individual sexually assault someone and then give them appropriate treatment for it if any is available. Of course, that'd take a lot of resources. Resources that few people would agree with allocating to something like that. They'd rather throw 'em behind bars indefinitely and call it a day. Or worse, throw them in front of a firing squad or inject poison into their veins. Our goal shouldn't be just to punish and segregate 'cause as soon as they get out (if they get out) chances are they'll be back.

Why is the only time I hear arguments about "the prison system should be about reform not punishment" come when it's a man getting off of rape charges and not about black people being arrested for non-violent drug crimes or anything else as non serious as that :saladga: It's like its the only argument you can make to possibly defend this indefensible man because it circumvents the whole "guilty vs innocent" part :rip: Like, yes that's true but why are people bringing it up about white male rapists who get off for crimes they clearly committed. 1 year of probation and 1 day of jail is not an appropriate or proportionate amount of punishment for raping two people with clear evidence and it sends the message yet again that sometimes rapists can just get away with things. Idk why the charges were dropped but still.

Even when people aren't getting 6 months or under a year or whatever, a good number of rapists are never officially convicted even when there is evidence, even more don't ever go to trial because the idea of there being no justice possible is very popular in people's mind BECAUSE of things like this. No one wants to go to court for months and replay in detail how they were raped to a prosecutor who will probably slut shame the person if they are a woman and make them feel responsible for their own rape when the chance of justice EVEN if the person is convicted is slim :smh:

We can argue about how prison isn't the most effective way to reform and rehabilitation and how America specifically has huge problems in regards to mass incarceration and that recidivism is high, we actively impede people's attempts to re acclimate to society by legally penalizing them AND stigmatizing their very existence, etc. etc. but it doesn't take away the fact that we can't reform the entire system over night and of all of the potential crimes for us to re-evaluate as deserving jail time, RAPE is not one of them. Rapists tend to keep raping people, especially in environments where people don't even want to report them. They DO pose an active threat to people Probation and 1 day of Jail will NOT rehabilitate this man. Fine, maybe x years in prison won't either, but hes essentially walking away unpunished at all from this, which goes on to reinforce the idea that "Some people can just get away with rape" --- its not a rare individual instance, its common and it often leads to people feeling like they can express their "rapey" inclincations in the first place, similar to other criminals who don't believe they will be caught.

I started that argument because probation was mentioned in contrast to a jail cell. The charges were dropped (for a reason we don't know) so I didn't see a reason to start talking about this guy. I take issue with you implying that I'm defending him though. Where/how?

There's never a news thread about black people being arrested for crimes like this (and if there were, you know everyone would defend them because all black people are Jesus now on this forum), so I don't get why you're bringing that up either.

See, that's just nonsense. I already stated in this thread that I don't believe either incarceration or probation is effective for rehabilitation but I also explained why and you don't mention that argument.

I mean, I get your point perfectly but I don't get why you're writing in that defensive tone as if people in here have posted the opposite opinion - they haven't.
