Anyways, I don't buy this "criminalization of HIV". If you sleep with someone, don't inform them of your positive HIV status and end up infecting them, you should be punished for that with jail.

The issue here is that HIV is treated far more harshly. All situations should be treated with the same amount of severity. Isolating HIV for no reason is not the way to go about it. So either make it a harsh crime for all severe diseases or be lax for all of them.

It's treated more harshly because there's no cure, it's lifelong (lifeshort without drug cocktails) and affects their life in very serious ways.

Right, because the blame (and I HATE to even use that word) could be placed back on the infectee  for not insisting the infector use protection (such a weird sentence ) Why must these things be so multi-layered? I do agree that if it's proven someone had sex with someone while knowingly carrying the disease and failed to inform them it should be punishable by law (and other life-threatening diseases should as well), but it is hard to prove. Unless you get it in writing or something. And that's super awkward and unlikely.

I know, but there are other diseases which are just as or even more dangerous in the short term that don't go unpunished.

HIV may be horrible but at least it doesn't render you invalid days after infection.

All I'm saying is that HIV should not be stigmatized.

Besides, this isn't the only issue that's being discussed regarding stigmatization. HIV discrimination is also a real thing.

Oh absolutely I do as well. I didn't even know people willingly infected others with HIV until last year; disturbing to even think people do this  Imagine having a small slip of paper prior to a grindr hook up

Any deathly sexually transmitted disease should be treated that way. Just because they all aren't punished like HIV doesn't mean HIV transmission shouldn't be punished at all.

Transmitting HIV is fatally negligent at best and homicidal at worst. I couldn't give a f*ck about the feels of HIV+ people or their stigma when it comes to serving justice.

As I said though, this wasn't the point. HIV is simply stigmatized and that needs to be removed. Fairness does not imply leniency.

Ah I see. The criminalization that is being referred to isn't necessary legal.

From a legal perspective, HIV/AIDs has a certain taboo about it that makes ruling against them to be disproportionately harsh or severe. 

From a societal perspective, HIV/AIDs is still being looked down upon and that's what Hillary addressed in the video. 

Then there's the often forgotten self-criminalization. HIV/AIDs is treated disproportionately more harshly by society despite it being neither contagious or airborne. There's a certain stigma that makes people less likely to want to confront it, and potential victims less likely to want to deal with it or get tested for it etc...

All of these factor into the HIV-specific criminalization that must be ended. Clearly there are certain factors that we discussed. Those should be the exceptions, not the rules.
