The U.S. codification of enemy spies is Article 106 of the Uniform Code of Military Justice. In military conflicts, espionage is considered permissible as many nations recognizes the inevitability of opposing sides seeking intelligence each about the dispositions of the other. To make the mission more easier and successful, soldiers or agents wear disguises to conceal their true identity from the enemy while penetrating enemy lines for intelligence gathering. However, if they are caught behind enemy lines in disguises, they are not entitled to prisoner-of-war status and subject to prosecution and punishmentâ€â€including execution.

Espionage is a crime under the legal code of many nations. The risks of espionage vary. A spy breaking the host country's laws may be deported, imprisoned, or even executed. A spy breaking his/her own country's laws can be imprisoned for espionage or/and treason (which in the USA and some other jurisdictions can only occur if he or she take ups arms or aids the enemy against his or her own country during wartime), or even executed, as the Rosenbergs were.

In United States law, treason,[14] espionage,[15] and spying[16] are separate crimes. Treason and espionage have graduated punishment levels; death is a mandatory sentence for spying.

if you ask the Pro-Palestinian members...they will tell you that the prisoners were really Israeli salesmen who didn't sell enough cookies this week...-

Plus if your counting... 18 people just got 'murdered' by Palestinians ...compared to a measly 3 Hamas Girl Scouts.... Just for numerical tabulations....8-/

 

IMO the only significance of the numbers here is that 18 people were executed intentionally and with government approval. I think its quite unlikely that all 18 were fairly convicted of spying; it seems more like a collective punishment in response to the attacks on Hamas military officials in recent days. Of course that is purely speculative...

If there is proof that they were working as spies for Israel there is no problem in their execution, as I posted above, many countries have same practises and laws during wartime, spies are not to be treated as prisoners of war.

As for collective punishment, isn't that what Israel is doing to Gazans over month now?

I really hope this conflict ends soon. The loss of life and quality is always tragic... I don't understand how Israelis and non Israelis can coexist in other countries, but can't in that one small piece of land. Can't share for peace and sanity's sake?

We can't share a piece of land with a terrorist organization that aims to kill us... I really hope that there will be peace soon, but I can't see peace in here when Hamas exists...

Yes I realize that, so I suppose more information is required. It is certainly a sketchy situation; among the chaos there it would be near impossible to receive a fair trial. I also just realized it was not carried out by government officials, but the article listed them as "gunmen" so Hamas has not taken responsibility for this so far.

:( Agreed. Even more unfortunate is that this will likely not be the end of conflict in Israel, no matter what the agreement is.

How many years of negotiations, plans, and ideas have been passed and there are people who are set on fighting, fighting, and fighting an endless war? Might as well label it hell on Earth. Here we are in the 21st century, with so much knowledge, technology, and ways to communicate, and somehow it seems impossible to work out a solution where everyone can live in peace. It takes a braver soul to stand up for peace and reason than give in to rage in their heart and find excuses for death and carnage. I wish people would let go of their pride and consider the lives of children and future generations to live a better life void of fear. Alas, one can dream...

Oh no no no, don't get me wrong, I didn't say that every Palestinian is a terrorist, of course not, but Hamas is in control of their land, and if we would merge governments, Hamas will be in part of control of Israel, and mess will happen and death from both sides, in unbelievable numbers because of Hamas.. Most of the Gazans are good people who wants peace as well as Israel does, but some are radical terrorists who wants to kill..

Currently, militants are launching rockets and mortars and grenade's ect. from civilian sites ...

There are d--g cartels, mafia, and crime syndicates or organizations that operate in the US and other Western nations, yet such groups are handled by law enforcement and corrections. However Latinos, Italians, Russians, Chinese, Japanese, and other nationalities somehow live in peace despite a minority of criminal elements.

If the extremists were prosecuted on trial and sentenced to prisons, it would save so many civilian lives as they would be out of the line of fire of bombs, tank shells, and machine guns.

The Israeli forces still have superior technology to defend against rockets and wouldn't law enforcement, if territories were shared, rather than military operations reduce collateral on both sides?

I realize there is still the threat of suicide bombers and car bombs, but with more control over the greater borders of the region, perhaps they could keep arms, weapons, and bombs out and protect the lives of both Israelis, Palestinians, and other civilians.

Now they're preparing us for another massacre, saying that mortar that killed 4 year old was fired from UNRWA school, then they corrected NEAR UNRWA school...how near? 1mile, 2 miles...? And where is the evidence, video?

I feel sorry for a death of Israeli boy, I wish more Israelis would show compassion and sadness over 560 Palestinian kids' death. Netanyahu is vowing to revenge, like he hasn't done enough? They really think the solution is more bombing?

that correction says a lot... how many of their "terror targets" are accurate then? this should be an important one and they couldnt get it right? and yeah, where is the evidence?

It turns out that more than 500 people that have been killed during Protective Edge in Gaza were terrorists. They are not that innocent then..

i went to a speaking event this evening. the speaker is pro-palestinian and quite controversial. 100+ pro-israeli people protesting the event, screaming at me "scum" and "shame on you" all in unison as i was walking solitary down the street towards the venue holding my ticket to get into the event, and waving huge israel flags (and anti-immigration flags! the irony). just because i went out to hear someone speak about the issue! i laughed at them. it was an enjoyable experience to be yelled at and called scum by hundreds of people i don't know just because i decided to hear another point of view. they were also chanting "bomb bomb palestine".

i was also searched with a metal detector and asked to remove everything from my pockets to be pat down searched as well. police were everywhere outside. because apparently i am a terrorist for even attending this event in which a man spoke for an hour about several topics, including the israel-palestine conflict. interesting experience.
