MONTREAL (AP)  A Canadian woman who parked her car on a highway to help a group of ducklings on the side of the road was found guilty Friday of causing the deaths of a motorcyclist and his passenger daughter who slammed into her car.

 

Emma Czornobaj was convicted by a jury on two counts of criminal negligence causing death, a charge that carries a maximum life sentence, and two counts of dangerous driving causing death, which comes with a maximum of 14 years in jail.

 

The 25-year-old was charged in the deaths of Andre Roy, 50, and his daughter Jessie, 16.

She wiped away tears when the verdict was delivered to a packed courtroom in Montreal. Quebec Superior Court Justice Eliane Perreault said the 12-member jury voted unanimously.

Czornobaj was released until her pre-sentence hearing on Aug. 8. Roy's motorcycle slammed into Czornobaj's car, which was stopped in the left lane of a provincial highway south of Montreal in 2010. Czornobaj, a self-professed animal lover, told the court that she did not see the ducklings' mother anywhere and planned to capture them and take them home...

 

Defense lawyer Marc Labelle said his client was stunned by the jury's decision.

"The fact that she was involved in the accident in the first place was a hard experience for her," he said. "The fact that she had to go through a trial with a lot of publicity was tough and to be confirmed by 12 citizens, the jury, that the conduct was criminal is a hard blow."

Roy’s wife, Pauline Volikakis, who was riding her own motorcycle behind her husband and daughter and managed to avoid injury, witnessed the accident in horror. Pauline briefly fought back tears when she left the courtroom. "I don't wish misfortune on anyone," Volikakis said. "It's time that we go on. This will not bring (back) my loved ones."

 

Prosecutor Annie-Claude Chasse had a message for motorists.

"What we hope is that a clear message is sent to society that we do not stop on the highway for animals. It's not worth it."

California Vehicle Code Sections:

22504. (a) Upon any highway in unincorporated areas, a person shall not stop ... any vehicle, whether attended or unattended, upon the roadway when it is practicable to stop ... the vehicle off such portion of the highway...

22109. No person shall stop or suddenly decrease the speed of a vehicle on a highway without first giving an appropriate signal in the manner provided in this chapter to the driver of any vehicle immediately to the rear when there is opportunity to give the signal.

22400. (a) ...No person shall bring a vehicle to a complete stop upon a highway so as to impede or block the normal and reasonable movement of traffic unless the stop is necessary for safe operation or in compliance with law.

21718. (a) No person shall stop, park, or leave standing any vehicle upon a freeway which has full control of access and no crossings at grade except: (1) When necessary to avoid injury or damage to persons or property.

I skimmed the story, but shouldn't the car behind be at a distance where they can stop suddenly?

 

As horrible as it is driving and hitting an animal - it's safer :/

She tried to be helpful and tried to fulfil her morals but didnt think of the possible consequences. It was in the middle of a high way, people drive fast and it very hard to be attentive of sudden stops. Regardless, in a law point of view she is wrong even though her intentions may have beeb good or morally correct.

Im not sure about 'Life' as a sentence is appropriate, even if shes in the wrong

...

Im picturing the dead's family going around praying she gets life in jail, even though the death was wrongful and unintentional (and did not even physically involve her person) and it leaves a bad taste in my mouth....

 

I can't imagine being in her position. I mean i know what she did was incredibly incredibly stupid, but people are self convincing, morals aside. You can convince yourself that "it will be ok if im just gone for 2 minutes" and people do this all the time, with illegal things or not. The feeling of confusion in this situation would be enormous. Shes young, probably still very immature. Being in the courtroom, to be pronounced LIFE in jail for this would probably shatter me. Suicide as soon as possible. 

 

I mean.. shes in the wrong, but i feel for her regardless, its sad because the deaths were not intended.

life in prison is a bit extreme, but she did cause the deaths of two people. she didn't MEAN to cause their deaths. but she did. Very sad. Hope she learns that you can't just stop in the highway like that.. theres a reason why you don't. cause this happens. Over the lives of some ducks. imo thats so stupid. Good that she cares about these animals but honey, you ended 2 peoples lives.

 

People >>> Animals. Don't try to argue that. Yes they both deserve an equal chance at life, but in this high danger situation.. people win.

 

This could have been a lot worse too.

Erm, It's the motorcyclists fault for not driving far enough away from her car to slow down. She was a little silly parking the car in the middle of the motorway, but chevrons are there for a reason. Furthermore, if she had time to stop and get out, that should have been more than enough for someone to see and slow down their vehicle. And to anyone saying that people are more important than animals, well  :fail:

Her sentence should at least be lessened. i mean she didn't mean to kill anyone and in the world rapists and killers are given easier sentences (some) whereas people like her (good at heart) get life imprisonment. :(

A Life Sentence is not going to teach her anything except that she was GRAVELY mistaken in her choices. I just cant begin to even comprehend the cognitive dissonance behind "i was trying to save some ducks" "i killed two people" "im never getting out of jail for it" ---

 

Shes not going to come out a changed woman who realizes the gravity of her actions, which is IMO the kind of sentence she should get. shes going to rot there for life. It still seems an unfair sentence that's only purpose is to act as an alternative to just putting her down right with the death penalty.

This is awful  :( I'm sure the blame was shared between this girl and the driver of the motorcycle.

 

A Life sentence is too extreme and won't fulfill anything. The girl is not a danger to society, the family of those who dies want to move on and don't want any retribution, the girl has learnt her lesson and will have to live with this for the rest of her life- that is punishment enough.
