Tbf, in that instance, if Gaga had sued, Gaga would be opening herself up to the can of worms of whether or not BTW was meaningfully derivative of EY (which I’d argue it isn’t, but she’d already gone thru enough hell with that at that point).

BUT what if it's a recorded show, filmed, and distributed and streamed as a individual show on a streaming gigant like Apple TV? I mean they could say they/Gaga earns money on the deal with Apple

True; but I think there’s about as much of a resemblance in Abra and Spellbound and they were credited.

I understand your point, but like he says: bare minimum is to give creds, either actual credits, money and/or at least letting them know the song sounds similar

Exactly. In the case of Adele against Toninho Geraes, Angra's guitarist was hired by Toninho's team to analize both songs. I saw a video that he explained he had to write a visual chart using symbols and colors in a way that the court would understand the technical stuff of theory, to compare the harmonies, melodies, prosody of the lyrics, pauses, etc. He said that when put side by side, they looked like a mirror of each other, and the case is still ongoing.

Everytime I listened to Express Yourself, I tried to find the similarities and never saw it (biased, obviously), then one day I was listening to Born This Way and it came, and then it went, it's like being cross eyed trying to make those stereograms work
