If they don’t have the votes, they don’t have the votes. Not really sure what “fighting harder” has to do with that. In theory, they would only need a simple majority, but without abolishing the filibuster, there would be a 60 vote threshold to even consider appointing a new Justice. Unfortunately, the Dems don’t have a simple majority atm that would be willing to abolish the filibuster, so without bipartisan support, any attempt to fill a vacancy in the Supreme Court would be DOA.
