For me, if I were a judge I'd probably give the maximum sentence especially if it results in severe injury. So many people died as a result of kids fights. One strike to the head and the kid is just gone. It makes me so sad.

Over the years I've just developed zero tolerance position towards severe physical violence. I don't care if someone didn't "intend" to kill. If their actions can result in the death of someone, they should be locked away from society.

My only issue with that is ur basically saying a serial killer or someone who premediates their victims deaths is on the same level of severity of someone having an outburst with possibly a lot of trauma behind that and as a general rule, death from such things are rare.

 

Basically its like saying it doesnt matter how much worse ur crime gets, how willfully u did it or even how many ppl u might have killed kill, ur punishment as that serial killer is not gonna be worst than the person who had a moment where they snappes cuz that person already got the maximum sentance

 

Ive been beaten up before by school bully but i still wouldnt personaly see justice in throwing him in jail as long as someone who planned murder premeditatedly and succeeded

 

Tho again, as far as OP goes i dunno if attempted murder and premediated murder in that state have a significant difference in prison time or not

Of course i had to edit it. I was frekin mad cuz i felt a lot of the response was unfair and made a lot of assertions that werent what i was trying to say and my original post as such was more stern 

 

But i realized arguing back would be pointless and unhelpful and achieve nothing now and unkind given hes triggered so i changed it to be a softer response (which for the record wasnt easy cuz i had a lot i wanted to say to that response but i chose to forgoe it anyway)

I mean aren't there different degrees of murder anyway? Maybe it's different in Canada.

But here in the U.S, there is first degree murder (which usually requires premeditation as you mentioned), and third degree murder (the lesser of the 3) is considered murder with no prior intent to kill.

All 3 deserve jail to varying degrees. And for me, let's say someone beats up a kid and they fall in a coma or something, even if they don't die, in my book that should be considered attempted murder.

But I don't know the specifics of this case, and whether he said he actually intended to kill her.

I guess its the wording and technicality. "Attempted" makes it sound like thats what u were trying to do and get punished along with ppl who actually were. 

 

But whatever works i guess. And again i wasnt suggesting they shouldnt serve some jail time. As long as the distinction from 1st degree to 3rd degree is very significant i can live with it

 

And someone said aparently he did actually say it. Which from a law perspective the assumption will now be that he was trying to kill her (but i do wonder cuz ppl say stuff all the time when they are angry they dont actually fully mean but theres no way to know)
