It started out as an Internet joke with the above as the ‘justification’ to mock SJWs and cancel culture then real life racists took  it over and now it’s a thing, I guess

Yeah, pretty much. Its started as a joke, but with most jokes on 4chan, a lot of people began regurgitating it unironically. Like how the Christchurch shooter made sure to flash the gesture in photographs during the trial.

I think the family would have to prove that the actor is racist or far right, which I presume shouldn’t be uncommon in Florida.

I think it may have just been a little gesture the character does and the actor uses since movements are the way they interact. I remember someone complained or threatened to sue because a Troll would fart out glitter. But if that character did that in the movie, why would you have a problem with it in real life?

It is in fact a gesture that's being used by white supremacist groups but it's also such a common and under certain circumstances important gesture that I think we shouldn't just let them take it away.
