It's more of a moral issue. Anyone who's a decent human being would not use Tracy's demo because she has refused many times after Nicki insisted. To use it knowing the artist doesn't want you to use it, shows lack of character. I highly doubt Nicki can win this one, because when you create something as an artist you usually always have the last word so I do think even if it was just a demo and Tracy messing around in the studio, that it cannot be used like that against her will.
