Maybe she should avoid sampling people who don't want to be sampled regardless though  it can't be that hard to replicate a song's groove if you're trying to work out something over it.

It's more of a moral issue. Anyone who's a decent human being would not use Tracy's demo because she has refused many times after Nicki insisted. To use it knowing the artist doesn't want you to use it, shows lack of character. I highly doubt Nicki can win this one, because when you create something as an artist you usually always have the last word so I do think even if it was just a demo and Tracy messing around in the studio, that it cannot be used like that against her will. Who knows though. 

Tracy Chapman is an amazing artist she's not just another "lady" lol

it's actually easy. you can experiment with whatever you want. the problem is when you give it to a radio DJ to play it. Nicki made it public before licensing. she'll lose this case but won't pay much because she didn't put it on the album
