Really? Yes, @Rescued had an extreme description but really? They can think on their own,  yes, but I'm sure that Rescued only hyperbolically meant to say that while they CAN think, they are not smart enough to consent to sex. They think they do but with a much older person, it's not a decision between equals. They can be manipulated. More mature than they've been doesn't change anything. And if you wanna be nitpicky, then yes, their brains actually are fully developed.  Minds, probably not.

I literally said in my post they're minds haven't been fully developed yet.  And I said nothing regarding to the case in the OP and of course I agree you have to be a complete idiot to have sex with a 13 year old and you're an adult.

13 year olds do have sex though, it's not like they cannot give their consent to having sex, but the problems are adults who are attracted to such young kids.

Thanks for clarifying. Yes, 13 year olds can have sex with other 13 year olds. Or 15 year olds. But they can't consent to sex with older people who are legally majors (I guess cause legally there has to be a cutoff) and that's because age creates a power imbalance in such situations.

Yeah, as @derpmonster said, I don't mean they know absolutely nothing at all, of course. It's all contextual to this specific conversation about sex and consent, I guess.
What I mean is that they know very little about sex, and by sex I don't mean the act of sex, but everything that surrounds it morally, emotionally, and philosophically. 
And sorry, but I stand by what I said. A young person might be able to tell you exactly what the act of sex is like, because they can read it from wikipedia and memorize it very easily, and you might say "wow this kid knows a lot, how mature" But they don't. They don't know. And never ever let yourself be fooled into thinking that knowing what sex is equals to being mature enough to engage in a sexual relationship. Especially with someone much older who probably will manipulate situations to get what they want.
An adult will be able to cope with being manipulated into sex. A child -and a 13 year old is most definitely still a child- might never be able to get over that.

I work in the criminal justice field and i am about to say something very controversial but i believe what he wanted to say is rape is very different when graphic violence is used. I see more than a dozen rape cases every year and it is true that some cases will use extreme violence that i wont even talk about cuz its the stuff of nightmares. However, that does not mean that some rapes are better or worse, we dont need to compare really. But i see what he tried to say, i think. Still does not make it OK i just want to make it clear he is completely wrong in comparing these situations, but i dont think he defended it, just minimalized it. Which is still not OK

The problem is that this poor child was already so damaged (thanks to her mother) that Roman and other people think that it wasn't rape. 

It was definitely rape. It is disgusting. No one should be defending Polanski. It doesn't matter how experienced this 13 year old was. All the other times it was rape too.
