But this is freedom. The government should not be able to force you to disclose your medical history to non-medical professionals, private citizens who can easily spread your information around, under threat of imprisonment. Condoms and Prep are sufficient in completely preventing the transmission of HIV through sexual intercourse, and even without condoms risk of HIV infection from through **** penetration from HIV positive individuals is only 1.3%. If they do become infected from not using protection, modern medicine makes it the case that they can live a long, normal life with undetectable and non-transmissible viral loads, and the US government (plus separate state and county funding) covers the cost of subsequent medical (and dental) treatment for life through the Ryan White program. Why should we imprison people for such low-risk behavior, when the was a consenting party? I would also encourage you to read my other posts on the matter since they bring up additional moral arguments.

I read your other posts as well. It's not about criminalising simply having HIV or having HIV and having consensual sex with others. It's about criminalising those who want to infect others through unprotected sex, that's all. It doesn't matter how much protection helps prevent it (condoms can split and even when using the condom and Pill correctly, babies have been conceived), if someone doesn't want to do it with an infected person, hence, put themselves at risk, they shouldn't be lied to. And I don't care how much healthcare you get to ensure it's not a death sentence, no one wants to be on that! It's no consolation! Some people just don't want to take any risks with their sexual health, period. That right should be respected. Lying to anyone to get sex, therefore, attempting to get sex through false pretences, is wrong. To tell someone something they should've known before you did the deed is so despicable, I can't even.

As I understand it the statute is based on knowing transmission, meaning people that simply do not wish to disclose their medical information to a private citizen and pass on the disease would be penalized as well (correct me if I am wrong). Of course it is morally wrong to lie to someone, but mere moral wrongness is not and should never be the standard of felony behavior. In order to justify revoking someone's human right to not be encaged (and raped and enslaved), the burden is on the state to show a compelling public interest in incarceration. If, as I have shown, there is negligible risk and negligible harm, the state cannot make a valid claim of public interest in incarceration. You do not have a right to other person's extremely sensitive personal medical information just because you are having sex with them. Any person that values their health should take personal ownership of it and take appropriate preventive measures, rather than asking another person to entrust them with medical information that if leaked into the wrong hands could result in very serious consequences for the person.
