HIV is no longer a death sentence therefore the transmission of it should no longer be penalized as if it were. Parties that wish to not contract HIV should wear condoms. No person should be legally required to disclose their HIV status, which is highly stigmatized and may run the risk of facing significant social ramifications including loss of access to resources if the partner chooses to leak this information against their will, or face prison time. That is a horrible situation to put someone in and our government should not be treating such a vulnerable community like criminals just for being protective of their private medical information. Partners can and should opt for protection for their own safety. At the end of the day, they and no one else is responsible for their choice to wear a condom or not. When an HIV+ takes the medicines and they treat themselves very well, they can live a good and healthy life and the virus in their body is very close to zero so there are no chances at all for them to transmit it to another person during a sexual act. 2. This change of law is talking about HIV+ who are treating themselves with medicines and taking care of their body and life, so if we match it with point 1, that means that they are not transmitting the virus to their sexual partners, this is why there's no reason for them to tell their partners unless they want to and there's no reason to treat them like criminals because they are not, they take care of themselves and responsible for their life. 3. It becomes a crime when and only when the HIV+ is not on a treatment and is purposely transmitting the virus to others, with or without telling them, usually they tell them afterward as a "fck you, you are infected" and things like that, so they are criminals! For example - It's time to treat HIV+ as human being and not as a walking infections.. most of them live a happy life and they are taking care of themselves. You clearly made a choice to fck without a condom, you could say no but you didn't, you are responsible for your health, not your one night stand partner.. it doesn't matter if they told you or no, it's not changing the fact that you were irresponsible.
