You all realize GagaDaily makes money off Gaga's name every day right?

Youre allowed to sell merchandise with Gaga's or Beyonce's name or face on them. Those things aren't copyrighted.

Actually this.

Also I always see those artists at malls drawing famous people cartoons and selling them. Wouldn't that be illegal if this were the case?

Original drawing are protected I believe

However some people in here are right to say it's illegal to sell her name when connected to her likeness. Can't really get away with selling both (unless you get a lisence to do so

They also ask if they could not use the name 'Beyoncé' in their twitter handle because it's her name.

The twitter handle is being used to sell merchandise (trademarked merchandise at that).

Well regardless of age, they should have studied up copyright law beforehand.

Also considering Beyonce is HEAVY on copyright, they were playing with fire.

Walk down the runway but don't puke, it's okay. You just had 10 donuts today. Without frosting.

The definition of cease and desist is to threaten to sue

I know that. My point is that cease and desist typically don't lead to actual lawsuits and the language used in this instance clearly supports this. I thought  this was well laid out in the unbolded portions of my post...

I went on to say that it's clear her team simply wants the trademarked work removed and her name disassociated with it. The title is accurate, but still misleading. 'Teen sells trademarked work of Beyoncé, receives cease + desist' is a little more transparent.

Next time consider reading the whole post instead of bolding the second and third sentence to make a non-existent point.

The kid could have drawn original pictures on these shirts and been fine

It's just extreme to do to a kid

Beyoncé is copyrighted

Lady Gaga is copyrighted

Your name is literally the 1st thing you copyright when you start a career/company

There's nothing harder for people to do than admit they were fooled.

It says Beyonce has copyrighted the words "boy bye." Seriously?!?!? So have these lawyers ever sent letters like this to the countless of places that sell shirts that say "I woke up like this" or "Surfboart" because I've seen so many unofficial shirts that say that. I've even seen a little make up bag that says "I got hot sauce in my bag."

Does es anyone have a picture of the designs of the shirts? Regardless if you're 15, he should have maybe researches the laws. It's admirable they're trying to make money, but they maybe should have taken a little extra caution.

There's nothing wrong in what her legal team did... it's the law. Regardless of your age you can't create merch based on someone else's image and then sell it and expect it to be okay because you're only 15.

Also its only a cease and desist, C&Ds are thrown around all the time in business and rarely ever turn into lawsuits, they're just the formal way to say 'stop it' to someone and have them take it seriously.

Knowing the story makes the title seems extremely clickbait-y now :laughga:
