Payola is technically illegal but it is pretty well-known and accepted that major record labels use loopholes such as using third party "promoters" to continue the payola practice legally. If only life were that simple and people didn't do things that are illegal. I also think you need to understand people at radio and people who work at record labels are all part of the same circles and probably have loads of informal ways of payolaring, which might not be technically illegal or might be impossible to prove.
