AFAIK, no, it's not required. But yeah, Madonna should have to pay royalties, even if using it without permission.

The thing that bothered me most -- even more than the video backdrop -- was the complete absence of a credit for "Born This Way" on the MDNA tour DVD. I never saw Madonna challenged on this point, but if she were, I can just picture her saying something like "well, she didn't give me any credit."

You don't need consent to cover a song on tour or even professionally on an album as long as the on the album the words aren't changed at all and credit is given in the right places.

Actually, Madonna had to pay to use Born This Way on tour. DJWS said he and Gaga both got a paycheck every time she sang it. 

And I'm pretty sure you have to have consent to put a cover on an album unless the album is free. You can't go off selling an album that has a song on it you don't own the rights to. That's the same as selling $10 Lady Gaga t-shirts outside one of her concerts: not yours to sell.

Sometimes I think that but at the same time look at the past. Ever since Madonna came on the scene she's always had a rude bitchy attitude. SO many artists got **** from her in the past. Whether it was Madonna just messing with them or not it left a bad impression and that's why some artists don't like her. I think Madonna is jealous of the girls after her getting praise it bugs the **** out of her. I like Madonna she's an awesome pop artist and IK she's not a horrible person but she's always had this whole "you have to be a bitch to succeed in this business" way of going about things which I get when she first started I'm sure it was hard as hell. But she doesn't have to be like that anymore you would think she would have learned from it all and not treat the artists after her like **** 😕

No. You don't need any consent. Do you think a club has to call Gaga to play poker face? no. Do they pay to play the song? Yes, they do.

Gaga did roll her eyes because this whole thing only paints Madonna in a certain color. She doesn't get affected by it. It's only publicity for Gaga either way. And Gaga even went on to say she's happy that someone as big as Madonna is singing her song on her world Tour.  Because this eventually is proof this isnt Madonna's song. As Gaga is being paid for it.

Macy gray said in an interview with Howard stern that you don't need permission to record a song as long as the song itself isn't altered (she was promoting her album of covers) so that's why I said what I said I assumed it went for live performances too but I guess not

I think a live performance of somebody else's song does not have to be approved of by the writer, but royalties have to be paid for performing it in a public venue.

I think even recording a cover doesn't have to be approved, as long as the writers are credited
