TMZ: Gaga denies claim by Kesha's lawyer that Dr. Luke raped her

You're not ****ing serious are you? Gaga just admitted something that happens to a LOT of rape victims: she was too traumatized and it took years for her to even accept for herself that he raped her. Most women don't report for a f*ckton of reasons (this being a rape culture we live in). Here are just a few, but there are many many more, rest assured.

- Police don't take rape accusations seriously in the least and it has been proven many times before that it's common for them to try to manipulate women into dropping the charges (especially if the rape wasn't committed by a total stranger);

- There is a statute of limitations to criminal prosecution for rape. If a woman wants to prosecute later because she couldn't before for any reason (for example PTSD, anxiety and all other byproducts of such trauma) but a couple of years have passed: too late! That rapist can never be criminally prosecuted and thus not punished, ever.

- People treat women who talk about their rape like absolute sh*t (victim-blaming, questioning everything about their rape, s-xual history, and SO much more). Victims, especially public ones, are almost inevitably dubbed attention wh*res and their accusation will haunt their public perception for the rest of their lives (paraphrasing Gaga in the exact interview we're talking about here: "I don't want my life, my achievements and my work to be reduced to one single moment in time a man did that to me"). Just look at Bill Cosby. 20+ unrelated women have come out over the years with similar stories that absolutely corroborate eachother and people are still victim-blaming them en masse. 20+ WOMEN.

- Trials can be immensely (re-)traumatizing and are highly likely to fail or will never even start;

- If you actually get a "rape kit" done (which is another invasion of your body and has to happen hours after the assault) it's highly likely it won't ever get used in court because there are literally more than 20,000 kits around the US right now dating from years and years ago just accumulating in warehouses because they're not being a--lyzed (even when the victims pay for those kits themselves, which is mandatory in some states);

I could go on for days and days listing the reasons.

You can be the "perfect victim" (stranger rape, not walking alone at night, wearing a ****ing burqa, having fought back and gotten wounds all over her body) who looks traumatized in all the "right ways" (read: doing everything people who know nothing about trauma THINK you should do and how you should act) and you're still damn unlikely to get any justice - and that's the understatement of the millenium. 3 out of 100 reported rapes lead to rapists seeing a single day in jail. Let that sink in for a moment. Your misogynist bullsh*t is the last thing this forum needs.

She didn't have to SAY rape to mean she was raped. I think it was hard even for her to talk about her experience let alone say the words..."I WAS RAPED!" Rob probably s-xually manipulated her into doing some questionable things and being so young (19 or 20)...it's a scary situation when someone is practically forcing themselves on you/in you. 

 

I also don't think it was just "molestation" if she said she practically wanted to ignore it happened and then it led her to d--gs and alcohol during TFM/BTW era

But we DO need evidence to prove someone is a rapist. People are innocent until proven guilty, and someone simply saying "I was raped," is not evidence- it's an accusation. If more people come out of the woodwork and corroborate a story we have something to work with, but it's still difficult to prove anything without evidence. 

 

Regarding treating women who report rape like sh*t - I agree with what you said there. Questioning the woman's s-xual history, what she was wearing, etc. and putting them on blast for being "attention w.hore*s," is information that is not important/constructive to the issue at hand at all. 

However, the victim (and person accused) does need to be questioned about what happened; the people handling the case need that information. 

 

If you get punched in the face you can't just say "I got punched by that guy," and expect to have them charged with no additional information or questioning. What happened before you were punched? What is their side of the story? They'll need to look at the bruise to see if it supports either story.

And if you try to report someone for punching you years after it happened you'll need proof that:

A) You were punched, and

B) It was that person

Even if three other people come out and say "This person also punched me," and their story corroborates yours, it's very difficult for the law to make a decision.

I think we need a system that takes rape victims seriously and also discourages false accusations. Currently, we live in a society that discourages false accusations (even though they still happen) while manipulating real victims to drop their cases. 

(I do understand that rapists go free WAY more often than someone falsely accuses rape)

 

When it comes to rape, the sad thing is that it's the VICTIM who is guilty until proven innocent. 

 

I think rape accusations need to be taken seriously and we need to stop victim-blaming. I think if we're going to live in a society that demands evidence, we need to look at the evidence we have- like the rape kits. We put so much money into "protecting our citizens and freedom," yet we have all this data with PROOF inside of it that we ignore. 

JUST investigating those rape kits alone and putting those rapists in jail, taking those women seriously, would help so much. It'd help women to be less afraid of coming forward, of going to get a rape kit after they've been abused, and would charge the criminals making them feel less invincible. People want to preach about catching criminals, but don't seem to care about looking at actual proof because for some reason rape isn't taken as seriously as other crimes. 

 

TL;DR - While I think accusations does not equal evidence and it's important to question victims, I think we go about it the wrong way and I basically agree with everything you've said. :P

While he shouldn't have opened his mouth if he didn't know the truth, doubting Kesha's alleged abuse based on her lawyer is not right either.

I believe this is just one of Gaga's hard luck stories she has, in her repertoire to show her struggle to success and garner fan sympathy, and she got taken advantage of this disgusting lawyer.  why talk about an alleged rape you havent reported to the authorities.  its defamatory and unfair, if the accused doesn't have   a chance ot defend himself, because too much time has passed.  can prove it either way, and its no one;s business.  but still geragos was a creep for getting publicity for his case in this manner.
