lol I never said she'd win the case.... was more just putting it out there as a thought. And wasn't part of her case" pain and suffering"? I just thought like maybe they will try to use the fact that she couldn't use the bathroom....

They let her use the bathroom when she explained herself though, it would be a different story if they didn't let her go at all.

Geez OK. I'll shut up then. I'm not saying Tim Horton's are in any way at fault, but in the article above, there is nowhere where it says she WAS allowed into the bathroom. Sorry for trying to have a thought about something.

I got a second degree burn on my forearm from accidentally touching the oven door at work three days ago. Should I tell the newspapers?

If they served the tea that hot than it's their fault. Tea or coffee should not be served at a temperature that will cause 2nd degree burns if it comes in contact with the skin. There is already a precedent set by the US case with McDonalds. Cases like this sound frivolous, but once you see the kind of damge that is done it really is a serious matter.

Pictures from the infamous McDonalds coffee case for reference in case anybody hasn't seen them. These burns are 2nd degree as well.

That doesn't make sense though. Tea has to be steeped between 170-190ish degrees depending on the tea. How else are they going to serve hot tea?

I'm afraid if courts mandated a lower serving temperature for safety reasons, the people who put tons of cream in and want to take it away and drink it 15 minute later, will complain it's not hot enough.

All the people in the other thread who voted they want to move to Canada instead of USA.

Enjoy your burns and tiny jury awards :usrs:

Even in the US she wouldn't win the case :usrs:

Canada should really do some research before trying to act snobby over something that was put on hot coffee for a specific reason. There's a post about it on Tumblr and I must say I enjoyed watching people spill some tea when it came to why Americans had to put something 'so stupid' on hot beverages.

Point is, there's warnings on **** for a reason. Cleaning products, beverages, hair products. It's not because of stupid people, it's for safety and lawsuit prevention.

It's not Tim Horton's fault, she chose to purchase a beverage and once it is in her hands it's her problem to deal with.
