The Game sues UMG and Virgin after underwhelming commercial performance of album

The Game is suing Virgin and UMG over his underwhelming album sales, claiming they didn't spend most of the promised advertising budget and that sales of the record suffered for it.

The legal complaint was filed by 100 Entertainment, the independent record label run by The Game. 100 Entertainment had an exclusive distribution deal with UMG's Virgin Music Group for his 2022 Drillmatic – Heart vs. Mind, which debuted at No. 12 with 25,000 units on the Billboard 200 in August 2022 and spent 2 weeks on the chart.
The album had a considerably underwhelming commercial performance, especially given its massive 30-song tracklist with 32 guest appearances including: Kanye West, Big Sean, Drake ... with production by Timbaland, Swizz Beatz, Mike Dean, and Hit-Boy.

The lawsuit claims that the album would have performed better if UMG had put more money into promotion. 100 Entertainment says UMG only spent $179K of the promised $500K recoupable marketing budget for the album, and overlooked key digital operations and ultimately spent none of the budget on radio play.

100 Entertainment claim they had to put up its own funds to keep the album rollout on schedule and covered a "substantial portion" of the music video production for the single "Stupid" with Big Sean, and UMG has yet to reimburse these costs.

100 Entertainment is suing UMG and Virgin for breach of contract. The label is seeking financial damages of at least $500K for the album's "diminished commercial performance."
