The main reason the tragedy happened was because of the nature of the situation. If you're promoting out of control behaviour in a concert packed with so many people, you're putting at risk their lives (and let's not talk about the ongoing pandemic without any distance restrictions). 

So yes, he's to blame. And also the people in the audience. In other words, this tragedy was product of collective human stupidity.

So he's financially liable for collective human stupidity? Every person who acted a fool is liable. Whoever physically trampled those people need to pay up including him. The idiots that surged need to stop pretending their irresponsible behaviors are 100 percent the fault of some pop star. That crowd acted a fool. Collective tom foolery. Humanity is trash.

It doesn't work that way. 

Riots and/or stampedes are often a result of mob mentality, sometimes also called pack mentality. This is a psychological phenomenon where people can be influenced by their peers to adopt a behavior pattern that is emotional rather than rational. This means that they would make different decisions in that moment than they would under normal circumstances. Now, in order for this to happen, there needs to be an inciting source. This sort of thing cannot and does not happen without a point of origin. In this instance, Travis Scott himself is the source as he was the one who was encouraging this sort of behavior. He was the one who got the crowd riled up, and not just on the night of Astroworld either. His concerts are known for this, and this is not the first time that people have been seriously injured at one of his shows. 

When it comes to large groups of people acting under mob mentality, prosecuting them individually is a fruitless endeavor because one you cannot prove liability for one of thousands and two it is a subconscious response to an outside influence. Travis was that influence as he was the one that was on the stage openly encouraging the audience to act this way. We can point to him as an origin point because we have the evidence of it. That's not to say that the people in the audience aren't at fault for taking his suggestion, but even then we could only point to the first few people who started behaving in a dangerous manner. By the time it trickled down to the rest of the crowd, it was far too late to get them under control and they just followed the leaders ahead of them into reckless behavior, caught up in the moment. 

Not really an excuse, but it's also not something punishable because they were not inciting the riot/stampede, Travis was.
